Right to disconnect - high income threshold

OK, I just learned that there is a high income threshold of $175k, above which the right to disconnect doesn't apply. There goes my right. What I am really frustrated is why is the threshold for high icnome $175K. This is even less than the highest tax bracket of $190K. It should have been set to DIV 293 threshold of $250K which I consider as legit high income.
