Are the sens really losing a draft pick?

From my understanding, Gary Bettman unlawfully stole a 1st Round draft pick from the Ottawa Senators and withheld that information from Michael Andlauer before he purchased the team. Could Andlauer sue Gary Bettman for fraud and recover this pick? Perhaps it would be a worthwhile avenue to explore. He just gained some capital by selling the Brantford Bulldogs, I reckon this move might be so he could get the funds to retain a crack legal team that will implement a legal strategy to get the missing 1st Round Pick back. It worked for Chicago when they got off with a slap on the wrist for covering up sexual assault within their organization. So there is precedent for a legal strategy. If we don't get the pick back another avenue is to threaten a Lockout. That should bring Bettman back to the bargaining table.

I had another idea, maybe Andlauer can keep delaying the year the 1st round pick will be taken until the NHL forgets or gets a new commissioner who will Pardon the Sens?
