IRS Not Updating EIN with Business Name After Switching from LLC to S Corp

Hi everyone,

I'm in a bit of a bind and could really use some advice.

I started my company in 2020 as a sole proprietor/LLC. For the 2023 tax return submission, my accountant filed IRS Form 2553 to switch my business from an LLC to an S corporation. The IRS accepted both the tax return and the Form 2553.

However, the IRS hasn't updated my EIN to reflect the new company name; it's still showing my personal name as the business name. This is causing issues because I can't pay my federal taxes (Forms 941/943/944) via EFTPS without the correct company name associated with my EIN.

I've already sent two mail requests to the IRS to update the business name—the last one was about 2-3 months ago—but I haven't received any response. When I called the IRS a couple of weeks ago, the representative told me they hadn't reviewed my mail yet and suggested I get a new EIN.

But according to the IRS website, specifically the "Do You Need a New EIN?" page, I don't need a new EIN for changing from an LLC to an S corp:

  • You will not be required to obtain a new EIN if any of the following statements are true:
    • "An LLC that already has an EIN chooses to be taxed as a corporation or as an S corporation."

So, I'm stuck. I need to pay my federal taxes, but I can't do so through EFTPS without the correct company name on my EIN. I'm hesitant to get a new EIN since it seems unnecessary and could complicate things further.

Has anyone else dealt with this issue? Should I go ahead and apply for a new EIN despite what the IRS guidelines say? Or is there another way to expedite the name change process with the IRS?
