Should I take legal action?

Hello, I've been thinking about taking legal action against the person who I contracted HSV-1 from. But I am curious if anyone else has gone down that route and what your experience was. A bit of background. He was a friend of mine who had been a FWB before I met my ex. When I broke up with my ex I reached out to him to hangout and have some fun. Because it had been awhile since we had had sex, I asked if he was clean and explained that I was and had recently been tested as well. He told me he was clean and we met up. Because I trusted him we didn't use a condom and I know that's a stupid mistake and I should have been smarter. When I tested positive for the STD I told him I had and then blocked him cause trust was broken. After talking to some friends they were recommending talking to lawyer to see if I have grounds because it is hard to think he didn't know about his status. However, I have done my research and I know that it can be passed asymptomaticly and live dormant for years before a first out break. So I am unsure if it would be worth taking action, plus I don't have our text conversations anymore from when we discussed it. So unless he still has it there's no proof we talked talked about being clean. Am I getting in over my head if I go this route? Is it a waste of time and resources?
