(NY) Medicinal Marijuana

Hi all! I live in an apartment complex with a lease stating there is absolutely no smoking in the building. I have had issues throughout the 3 years I've lived here where weed penetrates my apartment. My husband and I have complained to the landlord and have just posted signs stating no smoking in the building. Which people have ripped off. We have spoken nicely to neighbors and they have stopped especially because we now have a 3 year old and a 2 month old. Today, however, we have a neighbor who uses medicinal marijuana and purposely leaves his door open with a garbage can and penetrates the entire hallway plus seeps into my living room. We have asked him nicely twice and today he did it again and called the cops on my husband and I because he says we are harassing him to stop. We plan on speaking to the landlord tomorrow, but I have ZERO hope they will do anything b/c my neighbor across who has asthma has complained and nothing has changed. From a lawyers perspective is there anything else we can do?
